“Things aren’t always same as they look like, it is perception that matters. What matters more is the complete knowledge of the facts, facts that should be untwisted and raw. When imagination takes over reality, what transpires is a blunder. When such blunder involves life of the people, it doesn’t remain a mere mistake but becomes a crime, a sin.”
Aarushi-Hemraj’s Noida Double Murder case is no ordinary a
case. It makes for the most discussed and scrutinized criminal case of our
time. It all started on the fateful night of 15-16may. Till 15th may
Dr. Rajesh Talwar was a simple dentist who taught in ITS Dental College and
examined patients in Fortis Hospital and his private clinics. He did the same
thing on 15th may as well, may be for the last time ever.
Dr.NupurTalwar was also a practising doctor who visited her
clinic as usual on 15th may, picked up her daughter from school while
returning back home, had lunch with Aarushi and sister-in-law Vandana. After which they both left, leaving aarushi alone. Afterwards Nupur worked in Fortis till 7.00 and
returned home at night. Dr. Rajesh also returned back at 09.30pm from Hauz khaas clinic.
Aarushi’s birthday was coming. On 24th of the
same month she was going to complete 15 years of her life, the life that left
her before it. Venue for celebration was booked for 18; a sleepover with her friends
was planned for the weekend. Later parents were grilled by police on what was
the sleepover? Why it didn’t involve any adults? What would these girls do for which they wanted complete privacy from parents?
Talwar couple had a hard time convincing about the concept
of the sleepover. UP police was reluctant to give in to their explanations.
Ransacking the fridge and gossiping through the night wasn’t only thing that
Girls from DPS were supposed to do. No doubt DPS had left some other fantasy in
their minds.
Aarushi wished to have a camera for her birthday. Dr. Rajesh
had ordered it online. It reached them on 15th itself. Nupur
insisted to gift it right away as a pre-birthday surprise. It was gifted to
Aarushi. She was too happy, the camera was better than what she desired. She clicked
photographs enthusiastically. As any other teenager would do, she also deleted
few pictures that she would have not liked. Later, parents had to make explanation
for why there were not all photographs in the camera.
What exactly transpired in the intervening night of 15-16th
may is still not completely clear. What is clear is the fact that there is someone else
who surely knows the answers. This person or persons, is behind the bar or free
on the roads is a question that I would leave you to decide at the end of this
analysis.
On the morning of 16th may, the house maid rung
the bell. Nupur Talwar woke up and showed surprise over absence of Hemraj. She
threw away the keys to the maid from the balcony and told her to come inside.
Then she went in to the house and started looking for Hemraj. Dr Rajesh was
also awake by now; he came in the dining area and noticed a liquor bottle lying
there. Alarmed, she asked Nupur to check Aarushi. He himself went in to her room while
Nupur followed from behind. As per accounts they were shocked to see the condition of
the room, Rajesh Screamed, Nupur was dumbstruck, by this time maid was inside the
house. There was blood all around, Aarushi was lying on her bed, her throat
slit, head thrashed. Rajesh started banging his head against the wall and Nupur
started crying. Maid rushed out to call neighbors.
She testified about the above reactions of Rajesh and Nupur.
But as it be, once the theories pointing towards the parents being the killer
started floating in, to everybody else Rajesh and Nupur looked too composed to
have lost a daughter.
Just 4-5 days ago on the day of judgement I read several tweets about how composed Nupur looked on an interview she gave a few days after the tragedy. Indeed she was, she didn’t cry on camera. The senior journalist Sonia Singh who took the interview says about it, “She actually didn’t weep once in this interview and was pilloried for it! She hadn’t been tutored to cry for TV audiences”. She also has said repeatedly on the question of why Nupur was so stoical during her interview that when the camera was off she wept and wept, in a corner of the studio.

May be Nupur never knew the eager nation desperately wanted to see her
emotions, she thought her facts would do, she thought it would be better to
speak than cry helplessly.
People today are so used to reality television that they
forget real people don’t go by scripted cues to cry. Nupur was an ordinary
middle class women, she didn't knew to dramatize moments. It went away against
her in the most far-fetched manner.
Now let’s start with the so called circumstantial evidences.
It all began just after a few days of finding Hemraj’s
body. For police in a general case of theft or murder, the house help’s are the
first suspect. Based on this notion only, when the Aarushi’s body was found and
Hemraj was missing, the police promptly called it Open and Shut case and no, I
insist extremely none steps were taken to record any evidence. The crime scene
was in-bound for all. A murder in the posh area of a model city was a thing hot
off the press. Everyone was allowed to freely roam and inspect, no area was cordoned
off. Hundreds of relatives, friends, enthusiastic on-lookers and media persons
blessed the crime scene with their presence. The UP police botched the case even
before it became a double-murder mystery.
Soon after in a hastily called press conference a senior
Police officer, who according to notion took the center stage only after seeing the
huge presence of Media, unfurled the mystery. The things he talked about were
similar to what you could hear at a corner tea shop from a hyperactive idle
sitting Uncle ji, who takes proud in knowing everything about everything in the
world.
The infamous briefing described Aarushi having an illicit
affair with her 45 year old servant and Talwar’s finding them in compromising
position and killing them in a jiffy of anger. There was no prime explanation offered
on why did they think so, though the officer seemed confident enough and sure
enough as if he knew all about the case. It’s another fact that the officer
narrating this theory even forgot and misspelled the name of Aarushi several
times during the briefing. But based on his unquestionable instance the case
proceeded and concluded.
It was just after this that the whole country was
exhaustively fed with the facts that supported the theory. For media the story
of a 14 year girl and a 45 year servant involving sex and murder was too juicy
to question. It was very interesting, it suited the audience. The trp’s were
running high, the truth can take rest.
In India SEX is the most Taboo thing yet everyone loves
everything even remotely related to it. The theory of Noida Police appropriately
suited our fantasies. It gave hungry audience material to bash about the
high-profile lives of the big city people that were filled with all immoral
acts.
Later on it was established that No blood, No DNA, No semen
nothing at all relating to presence of Hemraj in Aarushi’s room was ever found.
Police said that the crime scene was dressed up and the Talwars have cleaned it.
Now notice this, when Aarushi’s body was found there was blood all around her
body, on bed and on walls behind her, these blood stains were there even when
police arrived. Now tell me a single possible way on how the Talwar’s would have
cleaned Hemraj’s blood selectively leaving behind only their daughter’s blood
on display. How, how??
Also between all this bloodshed a thing that remained completely clean is the clothes of the convicts, namely Talwar couple. They were wearing same clothes the night before as in morning; it was proven by pictures taken on Aarushi’s new camera which was seized by CBI. No heed was paid to it.
Also further examinations revealed that Hemraj was murdered
over the terrace, so this almost completely rules out the theory of in-a-spat
of anger honour killing theory.

Moving further, it was augmented in the court that how was
it possible for parents to be sleeping in the room when their daughter was
being murdered in the adjacent one.
First thing, the crime scene showed no sign of scuffle. Aarushi
was murdered in the bed as she lay sleeping. So off-course no shouting sounds were there.
And before moving to invoke evidence in this regard let’s encounter a
day-to-day experience. Hasn’t it happened to you that you have been slept
through in numerous calls at night? Hasn’t it ever happened that the early
morning calls of maid or sweeper went unheard. It happens, its feasibly possible.
I have described the schedule of talwar couple in great detail at the start to
establish that it was humanly possible to sleep through the night after a hefty
day at work.
Now moving to evidence, a 7 member team of AIIMS experimented
and found that the AC in Dr. Talwar's room produced ample noise to make other
things go unheard. That finally proves back that yes they could have been sleeping
through that fateful night.
Another popular piece of evidence in public domain is the
internet router being on-and-off. It was fed that as there was no power cut at
night and internet activity shows these signs hence Talwars were wake till late night and were doing this. Indeed on an examination it was found that on the
next day similar router activity continued when even the police was present and
there was no human intervention to the router. I hope that makes it clear
enough. Though I would like to tell that the router switch was there in the
Aarushi’s room and the people who conceived this theory to nab the Talwars
would kindly like to make me understand that what business according to them an
agitated father who has just killed his only daughter and servant would have
with repeatedly switching router on and off?
The irony in this case is not one but many. The case was
handled by two CBI teams. If you will study the interceptions of both the teams
you will find it hard to believe that both were working on the same case.
The First Team concentrated on Talwar couple as well as
three friends of Hemraj namely, Krishna, RajKumar and Vijay as suspects. They also
conducted several Narco analysis tests over them. Though the findings of Narco
tests are not admissible in court of law but still it is used to give right
direction to the case.
It was found in the narco that Talwar Couple showed no
deception over their statements. They showed no knowledge of any thing about
the fateful night of the murders. On the Other hand Krishna talked about his
presence in the house on that night and described the details of the murder.
Following this the Krishna’s house was raided and a khukri
was found with stains of blood over it. When it was sent for examination the
result was amazing. CBI almost encountered an alien-found moment during the case. The study
showed that this was not human blood, neither of goat, cow or chicken. They claimed inability in finding of what thing this blood was?
Next thing which was discovered from Krishna’s house was a
pillow cover. It also had blood. It was sent to Hyderabad for forensic; the
report which came back was revolutionary. It said the blood over the pillow was that of Hemraj. This thing, this evidence could have easily been used to bring a
conclusive end to the case, but No, that isn’t what happened.
Firstly, CBI sat over this report without noticing it at
all. It was only after the Talwars were made the main victim that their council
got this document to study and found the revelation. A senior officer accepted
that he didn't read the report as he was too busy with the investigations. No
doubt the way things were going, investigation hardly was dependent on any
reports.
What happened next can give your conscience and beliefs a
shock. CBI blatantly passed it off as a typing error. They claimed it was found
in Hemraj’s room and not Krishna’s. So according to them Krishna's Name was typed in
report at the place instead of Hemraj.
It will be amazing to know that the report was prepared by the Hyderabad laboratory and there has been no communication between the CBI and them for the past 18 months. But call it understanding or Intuition, CBI confidently knew that it was a typing error. When Hyderabad Laboratory was contacted afterwards about it, they said- if CBI believes it was a typing error than it was a typing error.
It will be amazing to know that the report was prepared by the Hyderabad laboratory and there has been no communication between the CBI and them for the past 18 months. But call it understanding or Intuition, CBI confidently knew that it was a typing error. When Hyderabad Laboratory was contacted afterwards about it, they said- if CBI believes it was a typing error than it was a typing error.
Do u think such arguments would even hold back good in a
school level debate competition? Here they were driving in the investigation of one of the most mysterious murder case in Indian history.
With the change in the CBI team everything else changed. The
murder weapon was replaced from a khukri to the golf club. The Talwars
voluntarily handed over their golf kit. Even one was found a very little cleaner
than others and it was said that Talwars cleaned it. Ironically the golf stick
that was finally presented as suspected weapon of assault by the CBI was a different
one, and not the marginally cleaner one. It should be notice that when the Golf
Sticks were brought in to the scene Talwars already had more than a year time
to get off with them. They didn’t.
Argument was made in the court that it was impossible for
servants to assemble in Hemraj’s room when Talwars were in the House. Indeed the
same council also said that it was completely feasible for Aarushi to make love
with Hemraj when her parents were in the next room.
Three bottles of liquors were found empty. Apparently if there
was no one else in the house that night than Dr. Talwar is the person to consume it all. He had a Sula wine, a scotch and a
bottle of bear on the night of murder. Large number of people who came in next
morning after murder including police personal neither smelled anything as such nor encountered any signs of the hangover.
Where we stand technologically would be more clear by the facts that, there was blood over bottle of liquor; there was a full hand print of
blood on the wall adjacent to hemraj’s body, but nothing could be attributed to
any known person. No DNA match’s could be established. Talwars repeatedly wrote
letters and requested to send the samples to foreign countries for further
examination, but to no use.
Talwars were denied access to evidences, reports and narco
findings during the conclusive hearing. They requested for witnesses it was
denied. CBI council every time said that they were just delaying the trial. Every
time a witness was denied nupur went to high court and Supreme Court. She was
denied there as well.
Dr. Rajesh and Nupur Talwar were the people who pleaded for
the investigations to continue even after CBI had filled it closure report,
citing lack of evidence.
Finally the case came to a conclusive end. With not a shred
of evidence and no particular motive the Talwars were found guilty and are
imprisoned for a life term.
You would not be surprised to know that Dr. Rajesh and Nupur Talwar's lawyer has asked for and apology from Aarushi case judge for ‘overlooking’ his arguments.
Aarushi murder case is a glaring example of media’s overdoing and unethical practice. Such action of media often induces the general public to believe in the complicity of the person indicted by the media thereby putting undue pressure on the course of fair investigation by the police. Privilege of presumption of innocence to which an accused is entitled to is blatantly discarded by the media in presenting facts, often distorted and unverified and presented with angularity pointing to the involvement of the person indicted in the commission of crime.
Aarushi murder case is a glaring example of media’s overdoing and unethical practice. Such action of media often induces the general public to believe in the complicity of the person indicted by the media thereby putting undue pressure on the course of fair investigation by the police. Privilege of presumption of innocence to which an accused is entitled to is blatantly discarded by the media in presenting facts, often distorted and unverified and presented with angularity pointing to the involvement of the person indicted in the commission of crime.
I respect the courts verdict but with complete dignity would
like to totally disagree with it.
I am not sure whether they did it or not, but my little brain with its limited capacity, after studying these facts can not digest that the theory of cucumstantial evidences pointing towards them without doubt.

Their crime is they didn’t look sad enough with Indian Standards; a Mother who doesn’t weep on camera is guilty as charged. Their crime is they had faith on the system. Their crime is they believed India is a free and fair nation. Their crime is they thought investigations involved evidences. Their crime is they believed false theories won’t last long in the courts. Their crime is they wanted the murderer of their daughter nabbed.

Yes they are criminals let them rot in the jail. Next
accompanying them may be I or You. Don’t think you are safe as you are very innocent
and you would never do any such thing. Even then if an officer decides and writes
a story involving you, your destiny would work as per his script.

Bug Bites You, or Raise Voice and Change Opinion, because opinions is what has
probably made two innocent souls convict of murdering their piece of heart.
When we keep quiet, knowing very well that injustice is
happening to others, everyone else will keep quiet when it
eventually happens to us.
