Aarushi Talwar- Anxious Wait for Judgement in A case of Questions and Beliefs.

She was all of 14; she loved watching Friends and Roadies. She loved reading novels. She was gifted a camera on the same fateful night for her upcoming birthday by her parents. She was reading Three Mistakes of My Life, just few hours before her dubious murder. Whose mistake was it to kill the little soul is yet to be established. The mystery that erupted after it, is still equally inconspicuous.

A 14 years old girl Aarushi Talwar got murdered on the night of 15-16 May 2008. A domestic help Hemraj was first to be blamed. But when his body too was recovered two days later, the blame was transferred to a former servant, whom hemraj has replaced. Sooner Aarushi’s own parents Rajesh and Nupur Talwar were added in the list of prime suspects together with three other accomplishes of hemraj who used to live nearby.

The former aide proved his presence in Nepal on the night of murder and was cleared off the investigation. The three friends of Hemraj who were made suspect also had alibis and neither their DNA nor fingerprints was found at the crime scene hence they were also let off in the lack of evidence. So taking in consideration that murder has happened and somebody did do it, the Talwar duo was singled out and all suspicion and focus shifted on them.

The media who was up on the heels right from the first day of murder never loosed the interest in the story. Barring some exceptions media flew with the wind. Talwars were subjected to intensified scrutiny and various indicative events were presented as the evidence. This case saw unparallel media trial. Every year on Arushi's death anniversary and birthday, a series of reports, documentaries were made incautiously blaming talwars for everything solely on the basis of some unexplained theories. When such stories concluded they hardly left anything to imagination. Rajesh and Nupur no more were the suspects but were made the proven convicts which media proved with ferocity time and again. Based on these an image was made out of them which showed them as harsh killers and cunning murders who are keeping the best investigation agency of India on their toes.

All sort of theories right from victims’ character assassination to her parent’s moral malpractices were presented to prove the point. Though none was supported with any solid piece of evidence.

Noida Double Murder Case as it is popularly known is more complex than even any movie made. There are very different versions of the stories. Neither the defence nor the prosecutors are known to present any solid evidence to effectively prove their points. Whole of the case is unanimously built around theories supported by circumstantial evidences. The versions of CBI and Talwars, both have discrepancies and are largely unsupported by any hard fact (atleast based on availability in public domain).

Let’s see the notable points that prove Talwar’s guilty and the ones that are against it.

Talwar’s are guilty:

• ·         Because no outside entry was established in the house.
• ·         They were reluctant to handover the key to terrace where eventually Hemraj’s body was found.
• ·         Aarushi’s room used to be locked at night with Nupur in the possession of the key, which could only warrant an entry in to the room from outside.
• ·         Surgical precision in the throat slit and alleged use of something like a Golf stick for hitting which Rajesh had.

*There are noteworthy defences to many of the above theories.

Talwars are not guilty because:

• ·         Hemraj’s awkward presence in Aarushi’s room is the base of most popular theory which establishes them guilty. Though there is no single substantial proof to show Hemraj’s presence in the room.
• ·         The clothes which Talwars wore on the previous night were in the same state in morning as well. No blood stains were found on them. This fact is established by the previous night photographs clicked by Aarushi and the driver who was last known outsider to see Aarushi and Hemraj alive.
• ·         The fingerprints of the parents were not found on the Scotch whisky bottle or the blood-stained clothes of the victims.
• ·         A recreation of the Air condition noise by scientist on CBI request supports the theory that it was possible for Talwars to stay slept and not to hear anything cause of the AC noise.

So there is much more perplexity in the case even after more than 4 years of investigation involving best Indian personals. It is really very very hard to predict which way the weigh-scale of justice would move, but one thing is for sure the decision is much awaited and is sure to put a decisive end to at least one of the theories. For other one would still remain unanswered.
